Please carefully review the following terms and conditions (referred to as the "Agreement") before using the website www.Remedy.sg and any other associated websites ("Websites" including www.OnlineDoctor.sg, www.DigitalHealth.sg), as well as the Digital Health Mobile/Web App and its various functionalities ("App") (collectively referred to as the "Platforms"). The Application provides users with access to a healthcare providers and services ("Services") provisioned by Digital Health Pte Ltd and its partners - Kingsway Medical Group (collective term for all Kingsway Medical Clinics).By creating an account on the Application using a mobile device ("Device") or through the Website, and by using our Platforms in general, you agree to abide by the terms of this Agreement. This includes all other terms and policies that are displayed on the Platforms (including any terms outlined in our Privacy Policy).
This is a legal document that binds you (referred to as "you" or "your") and Digital Health Pte Ltd and its health partners ("Digital Health Pte Ltd", "Kingsway Medical Group", "us," "we," or "our"). It governs your use of the Platforms, including the Websites and the Application, as well as any services, features, or functionalities provided through or in connection with the Platforms. Please refrain from using the Platforms if you do not agree to the terms of this Agreement or if you are ineligible to use the Platforms. It is important to note that our platform should not be used in the case of a medical emergency. If you are facing a medical emergency, please seek immediate assistance from a doctor in person or contact the emergency medical services number 995.
1. Account and Registration1.1 In order to access the Services through the Platforms, you will need to create an account. You can sign up for an account on the Platform. During the registration process, you will be required to provide your personal information, including your name, identification/passport number, policy number, date of birth, address, telephone number, email address, and any other information requested by us.
1.2 You are responsible for complying with all applicable security procedures introduced by Digital Health Pte Ltd from time to time.
1.3 You are solely responsible for maintaining the confidentiality of your account information for the Platforms, including your user IDs and passwords. You must not disclose this account information to any third party.
1.4 If you suspect that the security of your account information has been compromised, you must notify Digital Health Pte Ltd immediately.
1.5 By signing up for an account through the Platforms, you represent and warrant that:
a) You are at least 18 years old. If you are under 18 years old, you are not eligible to use this platform
b) You have the full right, power, and legal authority to enter into this Agreement.
c) All information, data, and details provided by you are complete, accurate, true, and correct.
d) You will use the Platforms for personal use only, and you will not authorize others to use your account or transfer/assign it to any other person.
Digital Health Pte Ltd reserves the right, at its sole discretion, to:
a) refuse your registration if you fail to meet any of the eligibility criteria mentioned above;
b) suspend/terminate your account under the Application; and/or
c) modify the eligibility criteria at any time.
1.6. If you are using the Services on behalf of a geriatric individual with special needs, such as vision or hearing difficulties, you must be present during any video or physical consultation with the geriatric. You must also be available at the time of product delivery upon making any purchases. You are responsible for payment for the Services provided to the geriatric individual, as well as the purchase and delivery arrangements for any products. You assume the obligations outlined in this Agreement as they relate to the geriatric individual.
2. Utilization of our platform and affiliated services
2.1 On the condition that you comply with the terms of this Agreement, Digital Health Pte Ltd grants you permission to use the Website and/or Application on your Device for the sole purpose of accessing the Services. All rights not expressly granted to you are reserved by Digital Health Pte Ltd.
2.2 Certain software components used in the Website and/or Application may be subject to third-party licenses, which will be notified to you. Your use of those components is governed by the terms of those licenses to the extent of any inconsistency between this Agreement and those terms.
2.3 In using the Website and/or Application, you agree not to (and not to authorize, allow, or assist any third party to):
a. Modify or adapt the Website and/or Application, or combine it with any other application, programs, or platforms created by you.
b. Disassemble, decompile, reverse-engineer, or attempt to derive the source code of the Website and/or Application or any of its components.
c. Communicate, republish, upload, post, transmit, edit, reuse, rent, lease, sell, assign, transfer, distribute, make available, license, sublicense, or create derivative works or adaptations based on the Website and/or Application.
d. Use the Website and/or Application in any unlawful manner, for any unlawful purpose, or in violation of this Agreement or any applicable laws. This includes infringing on Digital Health Pte Ltd's or any third party's intellectual property rights.
e. Use the Website and/or Application in a way that could damage, disable, impair, or compromise the Application, its systems, security, or other computer systems or devices, or interfere with other users or the reputation of the Website and/or Application or Digital Health Pte Ltd.
f. Post or transmit any files or emails containing viruses, worms, Trojan horses, or any other harmful or destructive elements.
g. Use any automated process or service to access and/or use the Website and/or Application.
h. Provide, distribute, share, or enable the provision, distribution, or sharing of the Website and/or Application (including associated data) with any third party.
3. User Responsibilities
3.1 It is your sole responsibility to:
a) Obtain all necessary hardware, software, and communication services required for using the Application at your own expense.
b) Ensure the security of your Device by taking appropriate measures.
c) Back up any data or content posted via the Application, as such data may be deleted by Digital Health Pte Ltd or its service providers without prior notice.
d) You are solely responsible for the accuracy and correctness of the information, health data, laboratory test results & images provided by you to Digital Health Pte Ltd and/or the Healthcare Provider.
e) You are personally liable for and obligated to pay any applicable fees or charges according to the terms in effect at the time they are incurred.
3.2 The permissions granted to you do not grant any rights to use other intellectual property rights owned by Digital Health Pte Ltd & its affiliates. This includes the "Digital Health" name, logos, service marks, slogans, product names, designations, and other proprietary indicia used in connection with the Platforms, which remain the property of Digital Health Pte Ltd and its affiliates. You must comply with all applicable laws.
3.3 Digital Health Pte Ltd reserves the right to:
a) Automatically update the Application and its components on your Device, add or remove functionalities, features, or services of our Application/Platform
b) Modify user account rights, impose restrictions, limits, or fees, suspend or terminate Application/Platform Functions and/or user rights.
c) Deny or restrict access to the Application or any Application Functions, either for specific users or in general, and block access to or from any resources at any time without providing reasons.
d) You agree that no claims can be made against Digital Health Pte Ltd and its affiliates in connection with such actions.
3. Utilizing Telemedicine, Allied Health and Affiliate Healthcare Services
3.1 Digital Health Pte Ltd may offer various healthcare/telehealth services on the Platforms, including medical consultations, and other allied services ("Healthcare Services").
3.2 If you choose to use the video consultation functionality, you acknowledge and agree to the following:
a) The Healthcare Providers who offer Healthcare Services are provisioned by Digital Health Pte Ltd and Kingsway Medical Clinics.
b) Video consultations are subject to the Healthcare Provider's acceptance at their sole discretion.
c) Each accepted consultation forms a separate agreement between you and the Healthcare Provider. Do note that Healthcare Providers are independent professionals. They are solely responsible for the Healthcare Services they provide to you and for complying with the requirements of their profession and licensing.
d) You understand that video consultations have inherent limitations, and in certain medical situations, physical consultations may be more appropriate for evaluation, diagnosis, and consultation. These situations include, but are not limited to: (i) urgent care or emergency conditions, (ii) serious conditions (e.g., severe pain, breathlessness, cardiac arrest), (iii) undiagnosed chronic conditions, and (iv) conditions requiring further investigations such as laboratory tests or imaging modalities.
e) You are responsible for the accuracy and correctness of the information, statements, and images, including symptoms, health history, photographs, laboratory test results, or diagnostic images provided/uploaded by you to the Healthcare Provider.
f) You must comply with any advice given by Healthcare Providers to consult a doctor or other healthcare professional in person or seek emergency or other necessary treatment.
3.3 Our health application may provide a health report containing recommendations and health targets. However, as this report does not consider a comprehensive psycho-social history of the individual, you acknowledge that these functions should not be relied upon independently without consulting a qualified doctor. It is important to understand that any information provided by our application/software needs to be validated by a qualified doctor through a consultation. While Digital Health Pte Ltd endeavors to ensure that the medical information provided is accurate and up to date, the user holds sole responsibility for verifying such information with a qualified doctor. You agree not to hold Digital Health Pte Ltd liable for any loss or damages arising from the use of our platforms and services.
4. Delivery of Goods (Medications & Health Supplies)
4.1 Digital Health Pte Ltd reserves the right to update its pricing of deliveries (if any) from time to time at its sole discretion.
4.2 Digital Health Pte Ltd may utilize third party services for the dispensing and delivery of medications, including Wellaway Pharmacy and Kingsway Medical Clinics. In the even that third party services are being used, while Digital Health Pte Ltd will put in place processes to ensure correct medications are being dispensed, you agree that we will not be held responsible for any errors made during dispensing of the medications by our third party providers.
4.3 All medications and health products are subject to availability.
4.4 You accept that while there are delivery timeframes, from time to time, delays can occur. In which case, Digital Health Pte Ltd will contact the user to arrange for delivery as soon as practicably possible, or otherwise, will reserve the right to cancel and refund the order.
4.5 You agree to be responsible for receiving the delivery at the scheduled timeframe. If you missed a delivery, you agree to pay a surcharge of $8 for re-delivery.
4.6 Upon receipt of medication, the user is responsible for checking product integrity to make sure it has not been tampered with en-route. You also agree to take a photo of the medications received in its original packaging - showing clearly the Drug Name & Dosage - to send back to our customer service specialist for verification. This is for our Doctors to check that the correct medications have been received.
5. Payment & Refunds
5.1 All payments where applicable, will have to be made prior to delivery of medication(s) or health products.
5.2 We may from time to time, request additional information to confirm your payment methods and identity. You agree to provide such information promptly upon request.
5.3 We accept payments via PayNow & Bank Transfer. The user assumes sole responsibility to ensure that bank transfer / payment details are accurate. Digital Health will not be responsible for erroneous transfers being made.
5.4 Digital Health reserves the full right to adjust the prices of our goods and services from time to time at our full discretion.
5.5 We do not accept refunds for medications / health products that have been purchased by the user - with the exception of damaged, lost, or expired goods.
6. Limitation of LiabilitiesThere are potential risks associated with remote medical consultation and prescription through a modality like Telemedicine, including but not limited to:
(i) Insufficient or inaccurate information transmitted due to factors such as poor lighting or sound, which may require in-person consultation with a doctor for appropriate healthcare decision-making.
(ii) Reliance on self-measurement and reporting of symptoms, including body temperature, blood pressure, and weight, which may result in inaccurate evaluation and diagnosis.
(iii) Limited access to complete health records.
(iv) Possibility of software, hardware, or data transmission problems or failures, which may impede evaluation, diagnosis, or treatment and cause disputes or delays.
Digital Health Pte Ltd shall not be held liable for:
(i) Any loss or damage incurred due to the use of your account information, the Platforms, or Services, including transactions, purchases, product delivery arrangements, and payments.
(ii) Any loss or damage resulting from your erroneous, wrongful, or fraudulent uploading of information, images, laboratory test results, or diagnostic images, or the provision of inaccurate information to the Platform or Healthcare Provider in relation to your use of the Platform or Services.
(iii) Any loss, damage, or liability arising from Services offered or Healthcare Products, excluding indirect and intangible damages such as loss of income and consequential damages.
(iv) Actions or inactions of service providers in relation to you, your activities, or the Services.
(v) Any suspension, discontinuation, upgrade, or modification to the Application or Application Functions carried out by Digital Health Pte Ltd, which may affect your use of the Services, Application, and/or Application Functions without prior notice.
In general, Digital Health services excludes any symptomatic and unstable patients. Our target users are stable chronics who are compliant to their medications, whom do not experience significant symptoms or complications from their chronic illness and/or their treatments. These symptoms include (non-exhaustive list) chest pain, shortness of breath, palpitations, giddiness, extreme thirst, hunger, polyuria, numbness, weakness, blurring of vision, blood pressure readings >160/110, headaches, abdominal pain, fever, decreased consciousness, lethargy. Therefore, by arranging a consultation and making using the services on our platform, you are declaring that:
(i) you are not experiencing any symptoms as a result of your medication(s) and/or chronic illness
(ii) compliant to your medications
(iii) able to show a record (i.e. blood pressure / sugar diary where applicable) of good control.
You agree to submit accurate information, and provide truthful responses to our doctors to ensure the safe delivery of continued medical care. Please note that the exclusions and limitations of liability mentioned in this Agreement are subject to applicable laws and do not apply to cases where such exclusions and limitations are prohibited, including liability for death or personal injury resulting from Digital Health Pte Ltd's negligence.
